These General Terms and Conditions of Sale govern the relationship between Casarredo Srl and the customer regarding the purchase of products made remotely via the internet on the website www.casarredo.it. For matters not expressly covered by these Terms and Conditions of Sale, reference is made to Legislative Decree no. 206 of September 6, 2005 (Consumer Code) concerning distance selling to consumers, and Legislative Decree no. 70 of April 9, 2003, regarding electronic commerce.

Casarredo Srl conducts its e-commerce business exclusively towards “consumers”, to whom the products offered on the Site are sold. “Consumer” means any natural person acting for purposes unrelated to any business or professional activity. Therefore, Casarredo Srl invites those who do not fall under the “consumer” category to refrain from placing purchase orders for products sold by Casarredo Srl on the website www.casarredo.it.

In line with the above-mentioned commercial policy, Casarredo Srl reserves the right not to process orders from entities other than “consumers” or orders that do not comply with its commercial policies. Buyers are strictly prohibited from entering false, invented, or fictitious information during the registration process required to activate the purchase procedure and related communications; personal data and email address must be the buyer’s actual personal data and not those of third parties. Both parties acknowledge that products displayed on the website may no longer be available or on sale when the user accesses the site and that related prices may be subject to updates. To ensure maximum transparency, Casarredo Srl will send an email to the customer containing order details.

Order Confirmation

The receipt of the order confirmation, transmitted by the customer via electronic means or by fax, constitutes the conclusion of the contract. By submitting the order confirmation, the customer fully acknowledges and accepts these General Terms and Conditions of Sale. Upon conclusion of the contract with receipt of the order confirmation by Casarredo Srl, the company will send the customer an email containing the details of the order.

Upon conclusion of the contract, Casarredo Srl commits to fulfilling the order within 30 days starting from the day following the date the consumer placed the order, without prejudice to Casarredo Srl’s right not to process orders from customers lacking sufficient creditworthiness.

If it is unable to fulfill the order due to the temporary unavailability of the product, Casarredo Srl may withdraw from the sales agreement by notifying the customer accordingly. In such a case, the customer will be entitled to a refund of any amount already paid.

Warranties

The products sold by Casarredo Srl are accurately depicted and displayed on the website to reflect their actual characteristics. However, Casarredo Srl cannot guarantee that the images and colors displayed on the customer’s monitor will perfectly match reality. For this reason, Casarredo Srl offers a “satisfied or refunded” policy (see Satisfied or Refunded Policy). Products are guaranteed with certification from the manufacturer and/or Casarredo Srl.

Force Majeure

Casarredo Srl shall not be held responsible for any disruptions caused by force majeure events such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods, or similar events that prevent full or partial fulfillment of the sales agreement within the agreed time frame. Casarredo Srl shall not be liable for any damages, losses, or costs incurred as a result of the failure to fulfill the sales agreement due to the aforementioned causes, nor for any damages, losses, or costs arising from the use or inability to use products purchased from the website www.casarredo.it. The customer shall only be entitled to a refund of the amount paid, excluding any shipping costs. Likewise, Casarredo Srl is not responsible for any fraudulent or unlawful use of credit cards or other payment methods by third parties at the time of payment, as Casarredo Srl does not have access to the buyer’s credit card number at any stage of the purchase process.

Contract Termination and Express Termination Clause

The obligations undertaken by the customer, including the guarantee of successful payment, are essential, and therefore, any failure by the customer to fulfill any of these obligations shall automatically result in the termination of the contract under Article 1456 of the Italian Civil Code, without the need for judicial intervention, without prejudice to Casarredo Srl’s right to claim compensation for damages.

Satisfied or Refunded Policy

The customer has the right to withdraw from the purchase without penalty and without providing a reason, within 10 working days from the date of delivery (as evidenced by the delivery date on the courier’s waybill). The right of withdrawal must be exercised by sending a registered letter with return receipt, including all purchased products, to the following address: Casarredo Srl, via De Pili, 22 Fano (PU), Italy. The communication may also be sent in advance by fax, provided that it is confirmed by registered letter with return receipt within 48 hours. The right of withdrawal shall be deemed correctly exercised if the following conditions are met: Products must not be used or damaged; Products must be returned in their original packaging; Products must have intact labels and price tags. Returned products must be sent to Casarredo Srl in a single shipment; Casarredo Srl reserves the right not to accept products from the same order returned and shipped at different times. Once the goods have been received, Casarredo Srl will refund the entire amount paid by the customer, excluding shipping costs, as soon as possible and in any event within thirty days from the date on which it became aware of the customer’s exercise of the right of withdrawal. If the customer does not comply with the conditions set forth in these General Terms and Conditions of Sale regarding the proper exercise of the right of withdrawal, they will not be entitled to a refund of the amounts already paid to Casarredo Srl. However, the customer may request, at their own expense, the return of the products in the condition in which they were returned to Casarredo Srl. If the customer chooses not to exercise this option, Casarredo Srl shall be entitled to retain both the products and the amounts already received.

Applicable Law

The contract is governed by Italian law.

Tolerance

Any tolerance by Casarredo Srl of behavior by the customer that violates the contract shall not constitute a waiver of its rights arising from the violated provisions or its right to demand the exact fulfillment of all obligations and to claim compensation for any damages suffered.

Jurisdiction and Competent Court

Any dispute relating to the application, execution, interpretation, or violation of the sales agreements made online or by fax through the website www.casarredo.it shall fall under the exclusive jurisdiction of the court of the consumer’s place of residence or domicile, if located in Italy.
